About this policy

This Privacy Policy explains how A.C.N. 119 098 083 Pty Limited trading as Infinity Financial (“Infinity Financial”, “we”, “us”, “our”) collects, holds, uses and discloses personal information, and how you can access and correct your information or make a privacy complaint. We are bound by the Privacy Act 1988 (Cth), including the Australian Privacy Principles (APPs), and, in relation to tax file number information, the Privacy (Tax File Number) Rule 2015.

This policy covers Infinity Financial’s accounting, taxation and business advisory services and our website, infinityfinancial.com.au. Our related practices, Infinity Wealth Pty Limited and Infinity Lending Pty Limited, provide their own services under their own regulatory regime.

What personal information we collect

The kinds of personal information we collect and hold depend on the services you engage us for. They typically include:

  • identity and contact details, such as your name, date of birth, address, telephone number and email address;
  • government-related identifiers we are required to handle to provide our services, such as tax file numbers (TFNs), ABNs and director identification numbers;
  • financial and taxation information, such as income, expenses, assets and liabilities, bank account details, superannuation, payroll and employment information, and details of your business and investment affairs;
  • information about your family and personal circumstances where it is relevant to your tax or financial affairs (for example, marital status and dependants);
  • identity verification documents and related screening information where we are required to conduct customer due diligence under anti-money laundering and counter-terrorism financing (AML/CTF) laws; and
  • information collected through our website, such as browser type, pages viewed, access times and referring sites, which we use in aggregate to understand how the site is used.

We only collect sensitive information (for example, health information relevant to an insurance or hardship matter) where it is reasonably necessary for our services and you have consented, or where the collection is otherwise permitted by law.

How we collect it

We collect personal information primarily from you directly — in meetings, by phone and email, through our client portals and software, and in the documents you provide. We may also collect it from people acting for you (such as your bookkeeper, financial adviser, lawyer or another accountant), from government agencies and regulators such as the Australian Taxation Office, from publicly available registers, and from third parties such as banks or software providers where you have authorised access. If you give us personal information about another individual — for example your employees or family members — you should only do so if you are authorised to, and you should refer them to this policy.

Why we use it

We collect, hold and use personal information to:

  • provide our accounting, taxation, compliance and advisory services, including acting as your registered tax agent and dealing with the ATO and other agencies on your behalf;
  • verify identity and meet our legal and professional obligations, including under taxation law, the Tax Agent Services Act 2009 and AML/CTF laws;
  • administer our client relationships, including billing, payment collection and records management;
  • communicate with you, including sending information we consider relevant to your affairs (you can opt out of non-essential communications at any time by contacting us); and
  • improve our services and our website.

We use and disclose personal information only for the purposes for which it was collected, for related purposes you would reasonably expect, with your consent, or as otherwise required or authorised by law.

Who we disclose it to

We may disclose personal information to:

  • our related practices, Infinity Wealth Pty Limited and Infinity Lending Pty Limited, so that we can provide a holistic service across your affairs, unless you instruct us otherwise;
  • third-party providers we use to deliver our services, including cloud software and data storage providers, outsourced administration, bookkeeping and processing providers, IT support providers and identity verification services;
  • specialist professionals we engage with your consent, such as lawyers, auditors, valuers or financial advisers;
  • regulators, government agencies and other bodies where required or authorised by law, including the ATO, the Tax Practitioners Board and AUSTRAC, and professional bodies conducting quality assurance reviews;
  • our professional advisers and insurers; and
  • any person to whom we are required to disclose information under a statutory obligation, court order or other compulsory process.

We take reasonable steps to ensure that service providers who handle personal information for us are bound by confidentiality and privacy obligations and use the information only to provide their services to us.

Overseas disclosure

Some of the providers we use store or process information outside Australia. This includes our outsourced administration and processing arrangements and some cloud software services. Before disclosing personal information to an overseas recipient, we take reasonable steps to ensure the recipient handles it consistently with the APPs, including through contractual arrangements.

Technology and artificial intelligence

We use technology, including software that incorporates artificial intelligence (AI), to help us deliver our services efficiently and accurately — for example, tools that assist with data extraction and processing, transaction coding, research, document preparation and meeting notes. Where these tools process personal information, we only use providers we have assessed as appropriate for professional use, under arrangements that impose confidentiality and data-security obligations, and we do not enter client information into publicly available AI tools that lack those protections. Output from these tools is reviewed by our professional staff, and responsibility for our services always remains with us.

We do not use computer programs to make decisions that could reasonably be expected to significantly affect your rights or interests without human review. If that changes, we will update this policy to describe the kinds of personal information used in that automated decision-making and the decisions involved.

Tax file numbers

We collect and use TFN information only as permitted by taxation law, and we handle it in accordance with the Privacy (Tax File Number) Rule 2015. TFN information is stored securely, access is restricted to staff who need it to perform their duties, and it is never disclosed except as permitted by law.

How we hold and protect your information

We hold personal information in our practice management and accounting software, secure cloud services and, in limited cases, paper files. We maintain administrative, technical and physical safeguards designed to protect it, including access controls, encryption in transit, multi-factor authentication and staff confidentiality obligations. We retain client records for at least the periods required by law (generally seven years, and longer where tax, AML/CTF or other obligations require) and then take reasonable steps to destroy or de-identify information we no longer need.

Data breaches

If a data breach occurs involving personal information we hold that is likely to result in serious harm, we will notify the affected individuals and the Office of the Australian Information Commissioner (OAIC) in accordance with the notifiable data breaches scheme in the Privacy Act.

Our website

Our website uses cookies and analytics tools that collect information such as browser type, operating system, pages viewed and access times. We use this information in aggregate to measure and improve the site. You can disable cookies in your browser, although parts of the site may not function fully. Our website may contain links to other sites; we are not responsible for the privacy practices of those sites.

Access and correction

You may request access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading, by contacting us using the details below. We may need to verify your identity before responding. We do not charge for making a request, and we will respond within a reasonable period (usually within 30 days). If we decline access or correction in the limited circumstances permitted by the Privacy Act, we will tell you why in writing and how you may complain about that decision.

Complaints

If you have a concern about how we have handled your personal information, please contact us using the details below. We will acknowledge your complaint promptly, investigate it and respond to you, usually within 30 days. If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner at oaic.gov.au or by calling 1300 363 992.

Changes to this policy

We review this policy regularly and may update it from time to time to reflect changes in our practices or the law. The current version will always be available on our website, and the date at the top of the policy shows when it was last updated.
